NOTICE OF FORECLOSURE SALE
STATE OF TENNESSEE, HAYWOOD COUNTY
WHEREAS, Abe Bond executed a Deed of Trust to Mortgage Electronic Registration Systems, Inc., as nominee for Village Capital & Investment, LLC., Lender and Netco Inc, Trustee(s), which was dated November 2, 2011 and recorded on November 21, 2011 in Book 93, Page 772, Haywood County, Tennessee Register of Deeds.
WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, Village Capital & Investment, LLC, (the ìHolderî), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on July 3, 2018, at 1:30PM at the usual and customary location at the Haywood County Courthouse, Brownsville, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Haywood County, Tennessee, to wit:
FIRST LOT: BEGINNING at a wood post found in the west margin of Binford Road (ROW 50 feet), said point being the southeast corner of Billie Jean Hayes as described in Deed Book 104, page 687; runs thence with the west margin of said road South 04 degrees 50 minutes 09 seconds West 50.00 feet to an iron pin set, said pin being the southeast corner of the herein described lot; runs thence with a new severance line through Nicholas J. Korn as described in Deed Book 191, page 470, South 90 degrees 00 minutes 00 seconds West 343.43 feet to an iron pin set, said pin being the southeast corner of Lot No. 2; runs thence with the west line of Lot 2 North 01 degrees 58 minutes 52 seconds West 239.11 feet to an iron pin set in the south line of Bernice Harper as described in Deed Book 164, page 104; runs thence with the south line of Harper and generally with a fence North 89 degrees 51 minutes 46 seconds East 74.83 feet to a 10 inch tree with fence; runs thence North 85 degrees 59 minutes 20 seconds East 82.72 feet to a 10 inch snag with fence in the south line of Lennie M. Pulliam and Bernice Harper as described in Deed Book 153, page 331; runs thence with a fence being the west possession line of aforementioned Hayes South 03 degrees 58 minutes 43 seconds East 195.58 feet to a wood post found, said post being the southwest corner of Hayes; runs thence with the south line of said Hayes North 90 degrees 00 minutes 00 seconds East 185.00 feet to the point of beginning, containing within these calls 1.10 acres of land as surveyed on April 7, 2009, by Evans & Associates Land Surveying, 320 South Washington, Brownsville, Tennessee.
SECOND LOT: BEGINNING at an iron pin set at the southwest corner of Lot 1, said point being the southeast corner of the herein described tract; runs thence with a new severance line through Nicholas J. Korn as described in Deed Book 191, page 470, South 90 degrees 00 minutes 00 seconds West 182.48 feet to an iron pin set, said pin being the southwest corner of the herein described lot; runs thence across the north line of said Nicholas J. Korn and continuing with a new severance line through Peggy M. Korn as described in Deed Book 172, page 312, North 01 degrees 58 minutes 52 seconds West 238.67 feet to an iron pin in the south line of Bernice Harper as described in Deed Book 164, page 104; runs thence with the south line of said Harper and generally with a fence North 89 degrees 51 minutes 46 seconds East 182.47 feet to an iron pin set, said pin being the northwest corner of Lot 1; runs thence with the west line of Lot 1 South 01 degrees 58 minutes 52 seconds East 239.11 feet to the point of beginning, containing within these calls 1.00 acres of land as surveyed on April 7, 2009 by Evans & Associates Land Surveying, 320 South Washington, Brownsville, Tennessee.
Being the same property or a portion of the same property conveyed to Abe Bond by Instrument dated May 06, 2009 from Nicholas J. Korn and Peggy M. Korn filed on May 06, 2009 as Document Number 16879 and in Book 65 at Page 829 in the Haywood County records.

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and
All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
