WHEREAS, Thomas Lee Houghton executed a Deed of Trust to Mortgage Electronic Registration Systems, Inc., as nominee for First State Bank, Lender and John C. Clark, Trustee(s), which was dated July 25, 2013 and recorded on July 30, 2013 in Book 113, Page 9, Haywood County, Tennessee Register of Deeds.
WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, U.S. Bank National Association, (the ìHolderî), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on October 31, 2018, at 1:00PM at the usual and customary location at the Haywood County Courthouse, Brownsville, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Haywood County, Tennessee, to wit:
Situate, lying and being in the 7th Civil District of Haywood County, Tennessee and being more particularly described as follows to-wit:
BEGINNING at an iron stake in the south margin and 25 feet from the center of Woodland Road leading east from a paved road to the Brownsville Country Club, said stake located 10 feet north of the northeast corner of the Brownsville Country Club property and the northwest corner of land in the name of Lyle Reid and John Clinton, of which this now described real estate is a part; runs thence with the south margin of Woodland Road as follows: South 89 degrees 25 minutes East 195 feet to an iron stake; South 67 degrees 55 minutes East 59.36 feet to an iron stake; thence through the land of Reid and Clinton as follows: South 0 degrees 26 minutes West 419.74 feet to an Iron stake; South 74 degrees 11 minutes West 259.88 feet to a stake in the east line of said Country Club; thence North 0 degrees 26 minutes East with the east line of the Country Club 515 feet to the beginning, and containing 2.73 acres.
THIS CONVEYANCE is made subject to Restrictive Covenants of record in Deed Book 122, page 258, Registers Office, Haywood County, Tennessee; also subject to all Easements, Restrictions and Setback Lines, as shown on the recorded plat in Plat Book 2, Page 33, Registers Office, Haywood County Tennessee as amended in Record Book 55, Page 527 and Record Book 59, Page 57, said Registerís Office.
BEING the same property conveyed to Thomas Lee Houghton by deed of Vernon B. Fly and wife Dona D. Fly, as recorded in Deed Book 232, Page 98, Registerís Office, Haywood County, Tennessee. The said Thomas Lee Houghton conveyed the property unto Thomas Lee Houghton and wife, Periann Houghton, as tenants by the entirety, by Quitclaim deed recorded in Deed Book 259, Page 390, said Registers Office. Thomas Lee Houghton and Periann Houghton are divorced and Perriann Houghton conveyed her interest in the property to Thomas Lee Houghton by deed recorded in Record Book 105, Page 625, said Registers Office.

All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
