NOTICE OF FORECLOSURE SALE
STATE OF TENNESSEE, HAYWOOD COUNTY
WHEREAS, Brenda Jeter Byrum A/K/A Brenda King and Stan E. King executed a Deed of Trust to Beneficial Tennessee, Inc., Lender and Trace Robbins, Trustee(s), which was dated June 22, 2006, and recorded on June 26, 2006 in Book 24, Page 471, Instrument Number 5851 in Haywood County, Tennessee Register of Deeds.
WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, U.S. Bank Trust, N.A., as Trustee for LSF10 Master Participation Trust, (the ìHolderî), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on April 1, 2020, at 1:00PM at the usual and customary location at the Haywood County Courthouse, Brownsville, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Haywood County, Tennessee, to wit:
THE FOLLOWING PARCEL OF REAL ESTATE BEING IN THE 1ST CIVIL DISTRICT OF HAYWOOD COUNTY, TENNESSEE, AND MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS:
BEGINNING AT A STAKE IN THE NORTH MARGIN OF THE DANCYVILLE TO EUREKATON ROAD, WHICH STAKE IS 205 FEET FROM THE SOUTHWEST CORNER OF THE LEWIS JETER HOUSE LOT, AND IN HIS SOUTHEAST CARTER OF HIS RESIDENCE LOT, RUNS THENCE EAST WITH THE NORTH MARGIN OF SAID ROAD 4.50 CHAINS TO A STAKE IN THE NORTH MARGIN OF SAID ROAD, THENCE IN A NORTHWESTERLY DIRECTION ACROSS AN OPEN FIELD 8.22 CHAINS TO A STAKE IN SAID OPEN FIELD, THENCE WEST 2.80 CHAINS TO A STAKE IN THE CENTER OF A FIELD ROAD BETWEEN LEWIS E. JETER TRACT AND THE TRACT OF OPAL AND REVIE JETER LAY, THENCE SOUTH 8.66 CHAINS TO THE NORTH MARGIN OF SAID DANCYVILLE TO EUREKATON ROAD, THE POINT OF BEGINNING, CONTAINING APPROXIMAYELY 3 ACRES, MORE OR LESS. MEASURED APRIL 26, 1983 BY L. A. STUART.
BEING THE SAME PROPERTY CONVEYED FROM NEIL BRYUM TENANCY NOT STATED, TO BRENDA JETER BYRUM, TENANCY NOT STATED, BY DEED RECORDED 3/10/97, IN BOOK 217, AT PAGE 263, IN THE REGISTERíS OFFICE OF HAYWOOD COUNTY, TENNESSEE.

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and
All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
