WHEREAS, Felica Adams executed a Deed of Trust to Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Everett Financial, Inc., its successors and assigns, Lender and Banks Law Firm PA, Trustee(s), which was dated July 27, 2015, and recorded on July 27, 2015 in Book 133, Page 141, Instrument Number 35703 in Haywood County, Tennessee Register of Deeds.
WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, Tennessee Housing Development Agency, (the ìHolderî), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on July 14, 2020, at 1:30PM at the usual and customary location at the Haywood County Courthouse, Brownsville, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Haywood County, Tennessee, to wit:
Located in the 6th Civil District of Haywood County, Tennessee, and more particularly described as follows, to-wit:
BEGINNING at a PK nail set at the point of intersection of the centerline of Marvinís Chapel Road with the centerline of Mercer Road, said point being the northeast corner of Ruth Swain Hooper property described in Deed Book 92, page 414, Registerís Office of Haywood County, Tennessee (ROHC), of which a portion of the herein described is a part; thence running with the centerline of Mercer Road, north 50 degrees 26 minutes 04 seconds west, 141.35 feet to a point marking a northwest corner of the remaining portion of said Hooper property, said point being the northeast corner and true point of beginning of the property herein described; thence leaving said road and running With a severance line and the boundary of the remaining portion of Hooper, south 41 degrees 20 minutes 44 seconds west, passing an iron pin set in the south right-of-way line of said road and in a chain link fence at 25.01 feet, continuing with said fence, 120.97 feet to a fence corner, passing same, leaving said fence, and continuing, 35.03 feet, running in all, 181.01 feet to an iron pin set; thence north 50 degrees 14 minutes 21 seconds west, 132.82 feet to an iron pin set; and thence north 40 degrees 28 minutes 17 seconds east, passing a wood fence post at the end of a fence line at 44.41 feet, continuing with said fence, 98.03 feet to a wood fence post, passing same, leaving said fence, and continuing, 13.42 feet to an iron pin set in the south right-of-way line of Mercer Road, passing same and continuing, 25.00 feet, running in all, 180.86 feet to a point in the centerline of said road; thence running with the centerline of Mercer Road, south 50 degrees 11 minutes 49 seconds east, 92.19 feet; and thence south 50 degrees 26 minutes 04 seconds east, 43.39 feet to the point of beginning, containing 0.557 acres, including 0.078 acre in the right-of-way area of Mercer Road. BEING the same lot or parcel of land conveyed to Felica Adams by deed of Dorothy Swain Wells recorded in Record Book 133, page 139, of the Registerís Office, Haywood County, Tennessee.

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and
All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
