TO: ANY UNKNOWN HEIRS OF JAMES GRANDBERRY, DECEASED, AND ANY AND ALL PERSONS OR ENTITIES WHO HAVE OR MAY HAVE AN INTEREST IN AND TO THE TRACT OF LAND TO BE CONDEMNED IN THIS CAUSE.
Please take notice that on the 18th day of September, 2019 an In Rem Petition for Condemnation was filed in this Court against you, pursuant to Section 29-17-701 et seq of the Tennessee Code Annotated, praying for the condemnation for public purposes of the hereinafter described tract of land in which you have or may have an interest or right. The Petitioner seeks to acquire said property rights in Haywood County, Tennessee. The property to be condemned in this cause is more particularly described as follows:
HAYWOOD COUNTY TAX MAP 136, PARCEL 7.00 TRACT 3
10í PERMANENT EASEMENT FOR SANITARY SEWER 0.03 ACRES
BEGINNING in the west margin of Keeling Road, 25 feet from the centerline, at Ernestine Loganís southeast corner as described in Will Book F, Page 509 in the Registerís Office of Tipton County, Tennessee, being the northeast corner of James Grandberry as described in Deed Book 136, Page 306 in the Registerís Office of Haywood County, Tennessee (as shown on Tax Map 136, Parcel 7.00 in the Assessorís Office of Haywood County, Tennessee) of which the herein described easement is a portion, said point of beginning having Tennessee State Plane Coordinates of N 419828.44, E 934260.96; runs thence with the west margin of Keeling Road, south 03 degrees 14 minutes 34 seconds west 21.01 feet; thence following a curve to the left, having a radius of 325.00 feet, a chord direction of south 05 degrees 52 minutes 22 seconds east, a chord length of 102.98 feet and an arc length of 103.41 feet to the northeast corner of James Grandberry as described in Deed Book 136, Page 306 (Tax Map 136, Parcel 9.00), having Tennessee State Plane Coordinates of N 419705.02, E 934270.32; runs thence with Grandberryís north line (Tax Map 136, Parcel 9.00), south 75 degrees 24 minutes 13 seconds west 10.00 feet to the southwest corner of the herein described easement; runs thence 10 feet west of and parallel to the west margin of Keeling Road, following a curve to the right, having a radius of 335.00 feet, a chord direction of north 05 degrees 52 minutes 00 seconds west, a chord length of 106.08 feet and an arc length of 106.53 feet; thence north 03 degrees 14 minutes 34 seconds east 21.68 feet to Loganís south line, being the northwest corner of the herein described easement; runs thence with Loganís south line, south 82 degrees 56 minutes 02 seconds east 10.02 feet to the point of beginning containing 1,263.17 square feet or 0.03 acres of land as surveyed by Surveying Services, Inc., 41 Heritage Square, Jackson, Tennessee 38305 (731-664-0807).
The above described permanent easement shall be for the purpose of installing, construction, maintaining, repairing, operating, inspecting and removing force main lines and all fixtures, structures and appurtenances incidental thereto needed for the Pipeline Project in, over, and through the above-described tract of land for the development and use of the Megasite in Haywood County, Tennessee.
10í TEMPORARY CONSTRUCTION EASEMENT – 0.03 ACRES
BEGINNING in Ernestine Loganís south line as described in Will Book F, Page 509 in the Registerís Office of Tipton County, Tennessee, at the northwest corner of the above described 10í Permanent Force Main Easement and being a portion of the James Grandberry property as described in Deed Book 136, Page 306 in the Registerís Office of Haywood County, Tennessee (as shown on Tax Map 136, Parcel 7.00 in the Assessorís Office of Haywood County, Tennessee); runs thence with the west line of said 10í Permanent Force Main Easement, south 03 degrees 14 minutes 34 seconds west 21.68 feet; thence following a curve to the left, having a radius of 335.00 feet, a chord direction of south 05 degrees 52 minutes 00 seconds east, a chord length of 106.08 feet and an arc length of 106.53 feet to James Grandberryís north line as described in Deed Book 136, Page 306 (Tax Map 136, Parcel 9.00), being the southeast corner of the herein described easement; runs thence with Grandberryís north line (Tax Map 136, Parcel 9.00), south 75 degrees 24 minutes 13 seconds west 10.00 feet to the southwest corner of the herein described easement; runs thence 10 feet west of and parallel to the west line of the above described 10í Permanent Force Main Easement, following a curve to the right, having a radius of 345.00 feet, a chord direction of north 05 degrees 51 minutes 41 seconds west, a chord length of 109.18 feet and an arc length of 109.64 feet; thence north 03 degrees 14 minutes 34 seconds east 22.35 feet to Loganís south line; runs thence with Loganís south line, south 82 degrees 56 minutes 02 seconds east 10.02 feet to the point of beginning containing 1,300.99 square feet or 0.03 acres of land as surveyed by Surveying Services, Inc., 41 Heritage Square, Jackson, Tennessee 38305 (731-664-0807).
The above described temporary construction easement shall be used for the purpose of installing and constructing force main lines and all fixtures, structures, and appurtenances incidental thereto for the Pipeline Project. The Temporary Construction Easement shall expire three (3) years from the visible commencement of easement construction on the premises described herein.
HAYWOOD COUNTY TAX MAP 136, PARCEL 9.00 TRACT 2
10í PERMA NENT EASEMENT FOR SANITARY SEWER – 0.05 ACRES
BEGINNING at the intersection of the north margin of the CSX Railroad, 100 feet from the centerline, and the west margin of Keeling Road , 25 feet from the centerline, being James Grandberryís southeast corner as described in Deed Book 136, Page 306 in the Registerís Office of Haywood County, Tennessee (shown on Tax Map 136 as Parcel 9.00 in the Assessorís Office of Haywood County, Tennessee) of which the herein described easement is a portion, said point of beginning having Tennessee State Plane Coordinates of N 419531.26, E 934379.89; runs thence along the north margin of said railroad, south 64 degrees 30 minutes 51 seconds west 10.47 feet to the southwest corner of the herein described easement; runs thence 10 feet west of and parallel to the west margin of said Keeling Road, north 42 degrees 39 minutes 55 seconds west 47.98 feet; thence following a curve to the right, having a radius of 335.00 feet, a chord direction of north 28 degrees 49 minutes 15 seconds west, a chord length of 1 60.32 feet and an arc length of 161.89 feet to James Grand berryís south line as described in Deed Book 136, Page 306 (Tax Map 136, Parcel 7.00), being the northwest corner of the herein described easement; runs thence with Grand berryís south line (Tax Map 136, Parcel 7.00), north 75 degrees 24 minutes 13 seconds east 10.00 feet to the west margin of said Keeling Road, having Tennessee State Plane Coordinates of N 41 9705.02 , E 934270.32; runs thence with the west margin of Keeling Road, following a curve to the left, having a radius of 325.00 feet, a chord direction of south 28 degrees 49 minutes 36 seconds east, a chord length of 155.47 feet and an arc length of 156.99 feet; thence south 42 degrees 39 minutes 55 seconds east 51.07 feet to the point of beginning containing 2,089.72 square feet or 0.05 acres of land as surveyed by Surveying Services, Inc., 41 Heritage Square, Jackson , Tennessee 38305 (731 -664-0807).
The above described permanent easement shall be for the purpose of installing, construction, maintaining, repairing, operating, inspecting and removing force main lines and all fixtures, structures and appurtenances incidental thereto needed for the Pipeline Project in, over, and through the above-described tract of land for the development and use of the Megasite in Haywood County, Tennessee.

BEGINNING in the north margin of the CSX Railroad, 100 feet from the centerline, at the southwest corner of the above described 1Oí Permanent Force Main Easement, the herein described easement being a portion of the James Grand berry property as described in Deed Book 136, Page 306 in the Registerís Office of Haywood County (shown on Tax Map 1 36 as Parcel 9.00 in the Assessorí s Office of Haywood County, Tennessee); runs thence along the north margin of said railroad , south 64 degrees 30 minutes 51 seconds west 10.47 feet to the southwest corner of the herein described easement; runs thence 10 feet west of and parallel to the west line of the above described 1Oí Permanent Force Mai n Easement, north 42 degrees 39 minutes 55 seconds west 44.89 feet; thence following a curve to the right, having a radius of 345.00 feet, a chord direction of north 28 degrees 48 minutes 55 seconds west, a chord length of 165.17 feet and an arc length of 166.79 feet to James Grand berryís south line as described in Deed Book 136, Page 306 (Tax map 136, Parcel 7.00) and being the northwest corner of the herein described easement; runs thence with Grand berryís south line, north 75 degrees 24 minutes 13 seconds east 10.00 feet to the northwest corner of the above described 1Oí Permanent Force Mai n Easement; runs thence with the west lines of said force main easement, following a curve to the left, having a radius of 335.00 feet, a chord direction of south 28 degrees 49 minutes 15 seconds east, a chord length of 160.32 feet and an arc length of 161.89 feet; thence south 42 degrees 39 minutes 55 seconds east 47 .98 feet to the point of beginning containing 2,107.79 square feet or 0.05 acres of land as surveyed by Surveying Services, Inc., 41 Heritage Square, Jackson, Tennessee 38305 (731 -664-0807).
The above described temporary construction easement shall be used for the purpose of installing and constructing force main lines and all fixtures, structures, and appurtenances incidental thereto for the Pipeline Project. The Temporary Construction Easement shall expire three (3) years from the visible commencement of easement construction on the premises described herein.
You must plead, answer, or except to same as provided by law, or the In Rem Petition will be taken as confessed against you, whereupon the case will then be set for a hearing upon the record and in your absence.
IT IS ORDERED that publication of this notice be made for four consecutive weeks in the Brownsville Press, a newspaper published in Haywood County, Tennessee.
