NOTICE OF SALE
OF REAL ESTATE
WHEREAS, by Deed of Trust dated May 1, 2014, and recorded on May 30, 2014, appearing of record in Record Book 121, page 39, in the Registerís Office of Haywood County, Tennessee, Robert F. King conveyed to David Prince, Trustee, certain real estate therein described, to secure the payment of a certain indebtedness therein set forth to InSouth Bank; and
WHEREAS, the Deed of Trust was modified by Modification of Deed of Trust of record in Record Book 130, page 876 in the Registerís Office of Haywood County, Tennessee, and Modification of Deed of Trust of record in Record Book 148, page 787 in the Registerís Office of Haywood County, Tennessee.
WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and InSouth Bank the lawful holder of the note evidencing the indebtedness has declared the entire balance due and payable; and
WHEREAS, Charles C. Exum was appointed Successor Trustee by instrument appearing of record in Record Book 170, page 515 in the Registerís Office of Haywood County, Tennessee.
NOW, THEREFORE, notice is hereby given that on January 31, 2019 at 1 oíclock p.m., at the front door of the Court House in Brownsville, Tennessee, I will sell to the last, highest and best bidder for cash or for credit bid against the secured debt, and free from all right of homestead, equity of redemption, statutory right of redemption, and other rights and exemptions of every kind, including, but not limited to, a statutory right to elective share in the property, all of which were waived in the deed of trust, the following real estate lying and being in the 4th Civil District of County, Tennessee, and more particularly described as follows:
FIRST LOT: BEGINNING at a stake in the south margin of what is now known in the year 1961 as the Brownsville to Jackson Road or Highway No. 70 and 50 feet from the center of same, being the west line of a tract now in the name of Glen Bond Estate and being the northeast corner of this now described lot; runs thence with the west line of Bond, south 6.35 chains to a stake in the southeast corner of this lot; thence west 3.16 chains to a stake; thence north 6.1 chains, more or less, to the new right-of-way of the highway created by the construction of the overpass on Highway No. 70; thence with the new right-of-way east 0.7 chains, more or less, to the existing concrete right-of-way marker; thence north 14 degrees 23 minutes east with the said right-of-way 50 feet to another concrete marker 50 feet from the center of the road; thence south 75 degrees 37 minutes east 2.35 chains, more or less, to the point of beginning, and containing 2.0 acres, more or less, according to survey of F.W. Carter, County Surveyor for Haywood County, Tennessee.
SECOND LOT: BEGINNING at a stake in the west boundary line of a tract in the name of Mullen, being in the northeast corner of a 15 acre tract in the name of Earnest T. Jones (see Deed Book 92, page 215), and being the southeast corner of this now described parcel; runs thence with the north line of Jones, west 208.7 feet to a stake; thence across the open field, north 423.55 feet to the southwest corner of a 2.0 acre tract formerly conveyed to Waddell to Jim Currie, in the year 1974 known as the Fina Oil Station lot; thence with the south boundary line of the Fina lot, east 208.7 feet to the west boundary line of the above mentioned Mullen property; thence south 423.55 feet to the beginning and containing 2.029 acres, more or less.
Being the same property conveyed to Robert King, by deed dated September 17, 2010, appearing of record in Record Book 81, page 89, in the Registerís Office of Haywood County, Tennessee.

Said property will be sold by me as Successor Trustee only and subject to any unpaid taxes and assessments and all valid restrictions, covenants or easements, if any, of record on said property, and subject to any and all other liens having priority over the Trust Deed. The Successor Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale. The Successor Trustee may postpone any sale hereunder to another time or place by so announcing to all present at the time and place of the sale scheduled herein, without the necessity of any further notice whatsoever.
