NOTICE OF SALE
OF REAL ESTATE
WHEREAS, by Deed of Trust dated June 15, 1999, and recorded on June 15, 1999, appearing of record in Trust Deed Book 215, page 551, in the Registerís Office of Haywood County, Tennessee, James L. Robertson and wife, Annette Robertson conveyed to R. KEITH DAVIDSON, TRUSTEE, certain real estate therein described, to secure the payment of a certain indebtedness therein set forth to InSouth Bank; and
WHEREAS, the Deed of Trust was modified by Modifications of Trust Deed recorded as follows: Record Book 9, Page 102, Record Book 25, Page 170, Record Book 42, Page 181, Record Book 56, Page 131, Record Book 68, Page 124, Record Book 78, Page 900, Record Book 81, Page 475, Record Book 94, Page 855, and Record Book 126, Page 263 in the Registerís Office of Haywood County, Tennessee.
WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and InSouth Bank the lawful holder of the note evidencing the indebtedness has declared the entire balance due and payable; and
WHEREAS, the State of Tennessee, Department of Revenue, has filed a ANotice of State Tax [email protected] against James Robertson d/b/a Robertson Auto Body Shop in Record Book 119, page 215, in the Registerís Office of Haywood County, Tennessee; and
WHEREAS, notice of the sale of the Property pursuant to the Trust Deed was timely provided to the State of Tennessee, Department of Revenue, pursuant to Tennessee Code Annotated ë 67-1-1433(b)(1) by a certified letter dated December 31, 2018; and
WHEREAS, the sale of the Property will be subject to the right of the State of Tennessee to redeem the land as provided for in Tennessee Code Annotated ë 67-1-1433(c)(1); and
WHEREAS, Charles C. Exum was appointed Successor Trustee by instrument appearing of record in Record Book 170, page 513 in the Registerís Office of Haywood County, Tennessee.
NOW, THEREFORE, notice is hereby given that on January 31, 2019, at 1:15 p.m., at the front door of the Court House in Brownsville, Tennessee, I will sell to the last, highest and best bidder for cash or for credit bid against the secured debt, and free from all equities of redemption, homestead, dower and all other rights and exemptions, including statutory right of redemption after T.C.A. ß 68-8-101, all of which were waived in the deed of trust, the following real estate lying and being in Haywood County, Tennessee, and more particularly described as follows:
HOUSE and lot located on the east side of North Lafayette Street, and is thus described: BEINGS at a stake in the east margin of Lafayette Street, said beginning point being at the east face of the east curb of said street and approximately eight (8) feet South of the northwest corner of lot conveyed by Mrs. Ollie Rose and husband to John W. Norris and wife by deed in Deed Book 66, Page 466, said beginning point being the southwest corner of lot conveyed to B.W. Cobb and wife by John W. Norris and wife; thence with the east margin of said Lafayette Street South 72 feet to a stake at the east face of the east curb of Lafayette Street, the southwest corner of said lot or parcel of land conveyed to Norris by Ross and the northwest corner of lot or parcel of land conveyed to L.B. King and wife by D.J. Ross by deed in Deed Book 75, Page 447; thence with the south line of said lot conveyed by Ross to Norris and the north line of lot conveyed by Ross to King, East 150 feet to a stake, the southwest corner of the lot or parcel of land conveyed by John W. Norris and wife to B.W. Cobb and wife by deed of record in Deed Book 79, Page 214; thence North with west line of said Cobb lot 72 feet to a stake, the southeast corner of lot conveyed to B.W. Cobb and wife John W. Norris and wife and approximately eight(8) feet south of the north line of the lot conveyed by Ross to Norris; thence with south line of said Cobb lot West 150 feet to the beginning.
Being the same property conveyed to James L. Robertson and wife, Annette Robertson, by deed dated June 15, 1999, appearing of record in Deed Book 231, Page 671, in the Registerís Office of Haywood County, Tennessee.

Said property will be sold by me as Successor Trustee only and subject to any unpaid taxes and assessments and all valid restrictions, covenants or easements, if any, of record on said property, and subject to any and all other liens having priority over the Trust Deed. The Successor Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale. The Successor Trustee may postpone any sale hereunder to another time or place by so announcing to all present at the time and place of the sale scheduled herein, without the necessity of any further notice whatsoever.
THIS IS FOR THE COLLECTION OF A DEBT AND ALL INFORMATION RECEIVED WILL BE USED FOR THAT PURPOSE.
