NOTICE OF
SALE OF
REAL ESTATE
WHEREAS, by Deed of Trust dated November 4, 2008, and recorded on November 5, 2008, appearing of record in Record Book 60, page 583, in the Registerís Office of Haywood County, Tennessee, Veronica C. Coulston conveyed to LARRY BANKS, TRUSTEE, certain real estate therein described, to secure the payment of a certain indebtedness therein set forth to InSouth Bank; and
WHEREAS, the Deed of Trust was modified by Modifications of Trust Deed of record in Record Book 71, page 693, Record Book 94, page 484, and Record Book 125, page 190 in the Registerís Office of Haywood County, Tennessee;
WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and InSouth Bank the lawful holder of the note evidencing the indebtedness has declared the entire balance due and payable; and
WHEREAS, in proceedings in the United States Bankruptcy Court for the Western District of Tennessee, Eastern Division, in the case styled Jonathan Minton and Veronica Minton Bankruptcy No. 19-11260, Chapter 13, the Honorable Jimmy R. Croom, Bankruptcy Judge, has entered an order, by consent, abandoning property and modifying the automatic stay as to InSouth Bank, entered on June 26, 2019, permitting the Successor Trustee to sell at foreclosure the property described in the Trust Deed.
WHEREAS, Charles C. Exum was appointed Successor Trustee by instrument appearing of record in Record Book 176, page 790 in the Registerís Office of Haywood County, Tennessee. See also Scrivenerís Affidavit of record in Record Book 177, page 255 in the Registerís Office of Haywood County, Tennessee.
NOW, THEREFORE, notice is hereby given that on August 30, 2019, at 1 oíclock p.m., at the front door of the Court House in Brownsville, Tennessee, I will sell to the last, highest and best bidder for cash or for credit bid against the secured debt, and free from all right of homestead, equity of redemption, statutory right of redemption, all other rights and exemptions of every kinds, including, but not limited to, a statutory right and an elective share in the Property all of which were waived and relinquished in the deed of trust, the following real estate lying and being in the Seventh Civil District of Haywood County, Tennessee, and more particularly described as follows:
BEGINNING at a stake in the east margin of Washington Street, at the northwest corner of the lot sold to Duckworth by W. P. McCleish et ux by deed of record in the Registerís Office of Haywood County, Tennessee, in Deed Book No. 79 at Page 421; and runs thence North with the east margin of said Washington Street 79 feet to a stake, being the southwest corner of the lot formerly belonging to Warren, later Hayes and now Duckworth; thence East 260 feet to a stake; thence South 79 feet to a stake, being the northeast corner of said Duckworth lot first above mentioned; thence West with the north boundary line of said Duckworth lot 260 feet to the point of beginning.
Being the same property conveyed to Veronica Coulston (now Veronica C. Coulston Minton), by deed dated November 4, 2008, appearing of record in Record Book 60, page 582, in the Registerís Office of Haywood County, Tennessee.

The street address of the property is 718 N. Washington Ave., Brownsville, TN 38012.
Said property will be sold by me as Successor Trustee only and subject to any unpaid taxes and assessments and all valid restrictions, covenants or easements, if any, of record on said property, and subject to any and all other liens having priority over the Trust Deed. The Successor Trustee reserves the right to make oral announcements at the time of the public sale, which shall apply to the terms of the sale. The Successor Trustee may postpone any sale hereunder to another time or place by so announcing to all present at the time and place of the sale scheduled herein, without the necessity of any further notice whatsoever.
THIS IS FOR THE COLLECTION OF A DEBT AND ALL INFORMATION RECEIVED WILL BE USED FOR THAT PURPOSE.
