SALE OF
REAL ESTATE
WHEREAS, by Deed of Trust dated May 18, 2017, and recorded on May 25, 2017 appearing of record in Record Book 152, page 141, in the Registerís Office of Haywood County, Tennessee, Joe Duncan Ing and wife, Katrina Denise Ing conveyed to DAVID PRINCE, TRUSTEE, certain real estate therein described, to secure the payment of a certain indebtedness therein set forth to INSOUTH BANK; an WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and InSouth Bank the lawful holder of the note evidencing the indebtedness has declared the entire balance due and payable; and
WHEREAS, in proceedings in the United States Bankruptcy Court for the Western District of Tennessee, Eastern Division, in the case styled Katrina Ing, Debtor, Bankruptcy No. 19-11205, Chapter 7, the Honorable Jimmy L. Croom, Bankruptcy Judge, has entered an order, by consent, abandoning property and modifying the automatic stay as to Katrina Ingís one-half interest in 417 Cox Lane, Brownsville, TN, entered on July 25, 2019, which permits the Successor Trustee to sell at foreclosure the property described in the Trust Deed.
WHEREAS, in proceedings in the United States Bankruptcy Court for the Western District of Tennessee, Eastern Division, in the case styled Joe D. Ing, Debtor, Bankruptcy No. 19-10860, Chapter 7, the Honorable Jimmy L. Croom, Bankruptcy Judge, has entered an order, by consent, abandoning property and modifying the automatic stay as to Joe D. Ingís one-half interest in 417 Cox Lane, Brownsville, TN, entered on July 25, 2019, which permits the Successor Trustee to sell at foreclosure the property described in the Trust Deed.
WHEREAS, Charles C. Exum was appointed Successor Trustee by instrument appearing of record in Record Book 177, page 555 in the Registerís Office of Haywood County, Tennessee.
NOW, THEREFORE, notice is hereby given that on September 16, 2019 at 1:00 p.m., at the front door of the Court House in Brownsville Tennessee, I will sell to the last, highest and best bidder for cash or for credit bid against the secured debt, and free from rights to have the property marshalled, the equity of redemption, any statutory or common law right of redemption, homestead, dower, marital share and all other exemptions and other rights which might defeat, reduce or affect the right of the lender to sell the real estate for the collection of the indebtedness, all of which were waived in the deed of trust, the following real estate lying and being in the Sixth Civil District of Haywood County, Tennessee, and more particularly described as follows:
LOT ONE: BEGINNING at a metal post found at the southeast corner of Harris Hughes, 25 feet West of the center of Cox Lane, said point also being the northeast corner of Robnett as recorded in Deed Book 164, Page 511, Registerís Office, Haywood County Courthouse, Brownsville, Tennessee; thence South 0 degree 44 minutes 25 seconds East 200.00 feet along the west margin of Cox Lane, 25 feet from center, to a metal post set, said point being the southeast corner of Robnett as recorded in Deed Book 164, Page 511 and the northeast corner of Robnett as recorded in Deed Book 147, Page 690 thence North 88 degrees 18 minutes 36 seconds West 367.70 feet along the south line of Robnett to a metal post set; thence North 21 degrees 40 minutes 12 seconds East 212.62 feet across Robnett with a new line to a metal post set in the south line of Hughes; thence south 88 degrees 18 minutes 33 seconds East 286.57 feet along the south line of Hughes to the point of beginning, containing 1.50 acres, as surveyed by Walter R. Powell, RLS 932, on May 25, 1996.
BEING the same property conveyed to Joe Duncan Ing and wife, Katrina Denise Ing by deed of Jean Robnett, recorded in Deed Book 213, Page 232, Registerís Office, Haywood County, Tennessee.
LOT TWO: BEGINNING at a tpost found in the north line of Jean O. Robnett as described in Deed Book 147 Page 690, said pin being the southwest corner of Joe Duncan Ing and Katrina Denise Ing as described in Deed Book 213 Page 232; runs thence with a new severance line through Jean O. Robnett as described in Deed Book 164 Page 511, north 65 degrees 53 minutes 48 seconds west 233.71 feet to an iron pin set in the east line of Nancy F. Weddington as described in Deed Book 238 Page 102, said pin being the southwest corner of the herein described tract; runs thence with the east line of Weddington, north 00 degrees 44 minutes 32 seconds west 110.82 feet to an iron pin found, said pin being the southwest corner of Scott Simmons and Sara P. Simmons as described in Deed Book 223 Page 395; runs thence with the south line of said Simmons, south 88 degrees 18 minutes 32 seconds east 293.41 feet to a tpost found, said tpost being the northwest corner of aforementioned Ing; runs thence with the west line of said Ing, south 21 degrees 40 minutes 12 seconds west 212.62 feet to the POINT OF BEGINNING containing within these calls 41,066.41 square feet or 0.94 acres of land as surveyed by Evans & Associates Land Surveying, 320 South Washington, Brownsville, Tennessee. (731-772-2158) Said acreage being subject to all right of ways and easements, if any exist.
BEING the same property conveyed to Joe Duncan Ing and wife, Katrina Denise Ing by deed of Jean Robnett, recorded in Record Book 65, Page 841, Registerís Office, Haywood County, Tennessee.

Said property will be sold by me as Successor Trustee only and subject to any unpaid taxes and assessments and all valid restrictions, covenants or easements, if any, of record on said property, and subject to any and all other liens having priority over the Trust Deed. The Successor Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale. The Successor Trustee may postpone any sale hereunder to another time or place by so announcing to all present at the time and place of the sale scheduled herein, without the necessity of any further notice whatsoever.
THIS IS FOR THE COLLECTION OF A DEBT AND ALL INFORMATION RECEIVED WILL BE USED FOR THAT PURPOSE.
