NOTICE OF SALE OF REAL ESTATE
WHEREAS, by Deed of Trust dated July 27, 2018, and recorded on August 22, 2018, appearing of record in Record Book 165, page 861, in the Registerís Office of Haywood County, Tennessee, Jerry McClinton conveyed to DAVID PRINCE, TRUSTEE, certain real estate therein described, to secure the payment of a certain indebtedness therein set forth to InSouth Bank; and
WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and InSouth Bank the lawful holder of the note evidencing the indebtedness has declared the entire balance due and payable; and
WHEREAS, CHARLES C. EXUM was appointed Successor Trustee by instrument appearing of record in Record Book 179, page 694 in the Registerís Office of Haywood County, Tennessee.
NOW, THEREFORE, notice is hereby given that on December 2, 2019, at 1:20 p.m. at the front door of the Court House in Brownsville, Haywood County, Tennessee, I will sell to the last, highest and best bidder for cash or for credit bid against the secured debt, and free from all rights to have the property marshalled, the equity of redemption, any statutory or common law right of redemption, homestead, dower, marital share and any other exemptions and other rights which might defeat, reduce or affect the Lender to sell the Real Property or the Personal Property for the collection of the indebtedness ,all of which were waived in the deed of trust, together with waiver of all right of homestead, equity of redemption, statutory right of redemption and relinquishment of all other rights and exemptions of every kind, including, but not limited to, a statutory right to an elective share of the Property, the following real estate lying and being in the 7th of Civil District of Haywood County, Tennessee, and more particularly described as follows:

Lot 1 – Beginning on a point in the West margin of Hillcrest Drive, which point is the Northeast corner of Lot 13 and the Southeast corner of the herein described tract; thence from the point of beginning and with the North line of Lot 13, West 125.00 feet to a point in the East line of Lois Young; thence with the East line of Young, North 120.00 feet to the Southwest corner of Lot 11; thence with the South line of Lot 11 East 125.00 feet to a point in the West margin of Hillcrest Drive; thence with the West margin of Hillcrest Drive, South 120.00 feet to the point of beginning. Being Lot 12 of the West View Heights Subdivision. Surveyed by Reasons Engineering & Associates, Inc., RLS 1/508, Jackson, Tennessee, on June 17, 1993.
Being the same lot or parcel of land conveyed to Jerry E. McClinton by Special Warranty Deed recorded in Record Book 128, Page 810 in the Registers Office of Haywood County, Tennessee.

This conveyance is made subject to Restrictive Covenants and all matters shown on the plat of Walnut Hill Acres Subdivision as recorded in Plat Book 1, Page 104 as amended in Plat Book 2, page 55 & 56 and in Plat Book 2, page 100, of said Registerís Office.
