NOTICE OF SALE OF REAL ESTATE
WHEREAS, by Deed of Trust dated June 7, 2016, appearing of record in Record Book 142, page 494, in the Registerís Office of Haywood County, Tennessee (ìTrust Deedî), Dorothy Hess and spouse, Freddie Joe Hess, conveyed to Investors Title Company, a Tennessee corporation, Trustee, certain real estate hereinafter described, to secure the payment of a certain indebtedness therein described; and
WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and FirstBank, the lawful holder of the note evidencing the indebtedness, has declared the entire balance due and payable; and
WHEREAS, a Modification of Deed of Trust dated July 10, 2017 is of record in Record Book 154, Page 173, in the Registerís Office of Haywood County, Tennessee; and
WHEREAS, Adam C. Crider was appointed Successor Trustee by instrument appearing of record in Record Book 166, Page 337 in the Registerís Office of Haywood County, Tennessee.
NOW, THEREFORE, notice is hereby given that on Wednesday, September 26, 2018, at 10:00 a.m., at the front door of the Courthouse in Brownsville, Haywood County, Tennessee, I will sell to the last, highest and best bidder for cash and free from all rights to homestead, curtsey and dower, appraisement, and the marshalling of liens and assets relating to the Property, equitable and statutory rights of redemption and all other exemptions of every kind, all of which were expressly waived in the Trust Deed, the following real estate, more particularly described as follows:
Lying and being in the 9th Civil District of Haywood County, Tennessee, and being more particularly described as follows, to-wit:
COMMENCING at a point being the intersection of the center of Highway 54 West and the center of Southall Lane, thence along the center of Southall Lane with the following locative calls: South 0 degrees 48 minutes 20 seconds West 136.03 feet; South 12 degrees 00 minutes 00 seconds West 443.97 feet; South 13 degrees 43 minutes 32 seconds West 271.62 feet; South 13 degrees 48 minutes 40 seconds West 159.31 feet; South 14 degrees 28 minutes 15 seconds West 272.42 feet to a point, being the northwest corner and the point of beginning of the following described tract; metal post set on line South 73 degrees 37 minutes 44 seconds East 75.00 feet from said point of beginning; thence South 73 degrees 37 minutes 44 seconds East 273.19 feet across Hess with a new line to a metal post set; thence South 14 degrees 28 minutes 16 seconds West 160.00 feet across with a new line to a metal post set in the south line of Hess; thence North 73 degrees 37 minutes 44 seconds West 273.19 feet along the south line of Hess, old fence line found to a point in the center of Southall Lane; metal post set on line South 73 degrees 37 minutes 44 seconds East 53.99 feet from said center of Southall Lane; thence North 14 degrees 28 minutes 15 seconds East 160.00 feet along the center of Southall Lane to the point of beginning, containing 1.00 acre as surveyed by Walter R. Powell, RLS 832, on August 21, 1997.
Being the same property conveyed to Dorothy White, by Warranty Deed dated December 22, 2003, appearing of record in Deed Book 262, page 206, in the Registerís Office of Haywood County, Tennessee. Dorothy White, now known as Dorothy M. Hess as she is now married to Freddie Jo Hess.

The Successor Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale. The Successor Trustee may postpone any sale hereunder to another time or place by so announcing to all present at the time and place of the sale scheduled herein, without the necessity of any further notice whatsoever.
