WHEREAS, by Deed of Trust dated April 11, 2013, recorded in Record Book 109, page 889 of the Registerís Office for Haywood County, Tennessee, Donald R. Spencer, conveyed to Joanna Morris, as Trustee, the property situated in Haywood County, Tennessee, to wit:
SITUATED, LYING AND BEING in the Sixth (6th) Civil District of Haywood County, Tennessee, herein premises, and particularly described, to-wit: Known as the Dr. Julian K. Welch, Jr. Clinic. Bounded on the north by the property of S. J. Smith (his home place); on the east by Lafayette Street; on the south by Franklin Street; on the west by the property of Stehlin. Said lot has a frontage on Lafayette Street of 75 feet and on Franklin Street, 128 feet. Said lot is taken from a lot conveyed to S. J. Smith by Mrs. Bettie Everett by a deed. The west boindary of said lot runs along Stehlinís line for a distance of 75 feet and the north boundary of said lot runs along Smithís boundary line for a distance of 128 feet.
Being the same property conveyed to Donald R. Spencer and wife, Jayne T. Spencer, by deed of Lucille M. Welch, as recorded in Deed Book 140, page 304, Registerís Office, Haywood County, Tennessee. The said Jayne T. Spencer executed a Warranty Deed conveying her interest in said property to Donald R. Spencer, as recorded in Deed Book 144, page 407, Registerís Office, Haywood County, Tennessee.
Common address of property: 107 N. Lafayette, Brownsville, Tennessee 38012.

WHEREAS, the undersigned is the Substitute Trustee as appointed in the aforesaid Deed of Trust by a substitution, said appointment being in the manner authorized by the Deed of Trust; and
WHEREAS, default has occurred under the terms of the Note secured by the Deed of Trust, and the indebtedness evidenced therein is now wholly due, the owner and holder of said indebtedness, Simmons Bank, as Successor in interest to First South Bank, has requested the undersigned Substitute Trustee to sell the Property to satisfy same.
NOW, THEREFORE, notice is hereby given that on August 22, 2019, the substitute trustee will sell the property to the highest bidder for cash. The Trusteeís sale will occur on or about 10:00 a.m. at the main entrance of the Haywood County Courthouse located at 1 No. Washington Avenue, Brownsville, Tennessee 38012.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter than an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at any time. In addition, the following party may claim an interest in the above referenced property: Donald R. Spencer.
The right is reserved to adjourn the date of the sale to another date or time, and place certain without further publication, upon the announcement at the time and place for the sale set forth above.
