NOTICE OF SUBSTITUTE TRUSTEEíS SALE
WHEREAS, by Deed of Trust dated September 9, 2014, recorded in Record Book 123, Page 753-755 of the Registerís Office for Haywood County, Tennessee, Jerry McClinton, conveyed to Betsy S. Waddell, as Trustee, the property situated in Haywood County, Tennessee, to wit:
BEGINNING at a t-post found in the south margin of Highway 70 (ROW 60 feet) said t-post being the northwest corner of James Hughes, Tommy Hughes, and Martha H. Gay as described in Deed Book 260 Page 327; runs thence with said margin, north 48 degrees 06 minutes 45 seconds east 123.33 feet to a 3/8 inch iron post set, said post being the southwest corner of Dixie Webb as described in Record Book 58 Page 694; runs thence leaving said margin and with the south possession line of said Webb, south 84 degrees 34 minutes 00 seconds east, passing a t-post found at 194.93 feet, the southeast corner of Daisy Holcomb as described in Deed Book 214 Page 94, and continuing on for a total distance of201,08 feet to a 3/8 inch iron post found, said post being the northwest corner of Mary K. Hayes as described in Record Book 76 Page 194; runs thence with the west line of said Hayes, south 10 degrees 42 minutes 08 seconds west 222.02 feet to a 3/8 inch iron post found, said post being the southwest corner of Hayes; runs thence with the north line of John A. Jackson, Jr. and Barbara A, Jackson as described in Deed Book 148 Page 530, north 83 degrees 26 minutes 28 seconds west 67.89 feet to a wood post found, said post being the northwest corner of said Jackson; runs thence along the north line of aforementioned Hughes and Gay, north 51 degrees 15 minutes 23 seconds west 235.04 feet to the POINT OF BEGINNING containing within these calls 43911.09 square feet or 1.01 acres of land as surveyed on January 27, 2014 by Evans & Associates Land Surveying, 320 South Washington, Brownsville, Tennessee. Said acreage being subject to all right of ways and easements, if any exist.
This being a portion of the same property conveyed to Jerry McClinton via Special Warranty Deed recorded in Record Book 118 on Page 643-647 in the Registerís Office of Haywood County, Tennessee.
Property known as: 3148 US Highway 70 West, Brownsville, TN 38012.
Tax ID # 085-010.01.
WHEREAS, the undersigned is the Substitute Trustee as appointed in the aforesaid Deed of Trust by a substitution, said appointment being in the manner authorized by the Deed of Trust; and
WHEREAS, default has occurred under the terms of the Note secured by the Deed of Trust, and the indebtedness evidenced therein is now wholly due, the owner and holder of said indebtedness, Simmons Bank, as Successor in interest to First South Bank, has requested the undersigned Substitute Trustee to sell the Property to satisfy same.
NOW, THEREFORE, notice is hereby given that on December 6, 2019, the substitute trustee will sell the property to the highest bidder for cash. The Trusteeís sale will occur on or about 10:00 a.m. at the main entrance of the Haywood County Courthouse located at 1 No. Washington Avenue, Brownsville, Tennessee 38012.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter than an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at any time. In addition, the following party may claim an interest in the above referenced property: Jerry McClinton.
The right is reserved to adjourn the date of the sale to another date or time, and place certain without further publication, upon the announcement at the time and place for the sale set forth above.
