NOTICE OF TRUSTEEíS SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated 09/23/2009, and the Deed of Trust of even date securing the same, recorded 09/23/2009, in Instrument No. 18081; Record Book 70 Page 280-286, in Office of the Register of Deeds for Haywood County, Tennessee, executed by Shawn Lanier, conveying certain property therein described to Bobby M. Goode, State Director as Trustee for USDA Rural Development, as nominee for Rural Housing Service, U.S. Department of Agriculture., its successors and assigns; and the undersigned, The Sayer Law Group, P.C., having been appointed Successor Trustee by Bobby M. Goode, State Director, as trustee for Rural Housing Service, U.S. Department of Agriculture..
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of The Sayer Law Group, P.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Bobby M. Goode, State Director, as trustee for Rural Housing Service, U.S. Department of Agriculture., will, on 04/09/2019 on or about 12:00pm, at the Haywood County Courthouse, Brownsville, TN, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Haywood County, Tennessee, and being more particularly described as follows:
LYING AND BEING in the 7th Civil District of Haywood County, Tennessee, and being more particularly described as follows, to-wit:
BEING LOT 13, WESTFIELD SUBDIVISION, a plat of which is recorded in Plat Book 2, Page 206 in the Registerís Office of Haywood County, Tennessee and further described as follows:
BEGINNING at an iron pin set in the north right of way of Country Lane (25 feet from centerline), which point is the southwest corner of Dennis Tyus as recorded in Deed Book 228, Page 209 in the Registerís Office of Haywood County, Tennessee and the southeast corner of the herein described tract; thence from the point of beginning and with the north right of way of Country Lane, North 85 degrees 42 minutes 32 seconds West 100.00 feet to an iron pin set at the southeast corner of Sarita Johnson as recorded in Deed Book 227, Page 685 in the Registerís Office of Haywood County, Tennessee; thence with the east line of Johnson and then Arlisa Armstrong, North 12 degrees 13 minutes 13 seconds East 234.84 feet to an iron pin set in the south line of Mark E. Kendrick as recorded in Deed Book 215, Page 509 in the Registerís Office of Haywood County, Tennessee; thence with the south line of Kendrick, South 78 degrees 12 minutes 59 seconds East 99.05 feet to an iron pin set in the west line of Tony Lewis as recorded in Record Book 14, Page 132 in the Registerís Office of Haywood County, Tennessee; thence with the west line of Lewis and then Tyus, South 12 degrees 13 minutes 13 seconds West 221.80 feet to the point of beginning, containing 0.52 acre.
The above described lot has a 40-foot front building setback line as shown on final plat. Also there is a 20 feet of a 40-foor Utility Easement, which lies along the East of said lot as shown on final plat. Said lot is also subject to all rights of way, easements and restrictions of record.
BEING the same property conveyed to Shawn Lanier by Warranty Deed recorded in Record Book 70, Page 278, in the Registerís Office of Haywood County, Tennessee.
