NOTICE OF
SALE OF REAL ESTATE
WHEREAS, by Deed of Trust dated February 6, 2012 , and recorded on February 14, 2012, appearing of record in Record Book 96. Page 204, in the Registerís Office of Haywood County, Tennessee, ANTONIO L. SNIPES conveyed to EMILY DAVIS, TRUSTEE, certain real estate therein described, to secure the payment of a certain indebtedness therein set forth to INSOUTH BANK; and
WHEREAS, Modifications to Deed of Trust are recorded at Record Book 102, page 721 and Record Book 106, page 443 in the Registerís Office of Haywood County, Tennessee.
WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and InSouth Bank the lawful holder of the note evidencing the indebtedness has declared the entire balance due and payable; and
WHEREAS, the Internal Revenue Service filed a ìNotice of Federal Tax Lien Under Internal Revenue Lawsî against Antonio L. Snipes in Record Book 108, page 828, in the Registerís Office of Haywood County, Tennessee; and
WHEREAS, the Internal Revenue Service filed a ìNotice of Federal Tax Lien Under Internal Revenue Lawsî against Antonio L. Snipes, Sr. in Record Book 129, page 231, in the Registerís Office of Haywood County, Tennessee; and
WHEREAS, notice of the sale of the Property pursuant to the Trust Deed was provided to the Internal Revenue Service pursuant to I.R.C. Section 7425 by certified letter dated April 27, 2017.
WHEREAS, Charles C. Exum was appointed Successor Trustee by instrument appearing of record in Record Boo 140, page 189 the Registerís Office of Haywood County, Tennessee.
NOW, THEREFORE, notice is hereby given that on May 30, 2017 at 1:00 oíclock p.m., at the front door of the Court House in Brownsville, Tennessee, I will sell to the last, highest and best bidder for cash or for credit bid against the secured debt, and free from and free from equity of redemption, and any statutory or common law right of redemption, homestead, dower, marital share, and all other exemptions; Grantor waived all right of homestead, equity of redemption, statutory right and relinquished all other rights and exemptions of every kind, including, but not limited to, a statutory right to an elective share in the property all of which is set forth in the deed of trust all of which were waived in the deed of trust; the following real estate lying and being in Haywood County, Tennessee, and more particularly described as follows:
Tract 1: Situate, lying and being in the 6th Civil District of Haywood County, Tennessee, and being more particularly described as follows, to-wit:
BEGINNING at a point in the center of Coburn Road said point being the original northwest corner of Whitelawís 211.87 acre tract, Deed Book 194, page 642, Registerís Office, Haywood County Courthouse Brownsville, Tennessee; thence North 84 degrees 54 minutes 02 seconds East 50.51 feet along the center of Coburn Road to a point being the northwest corner of Davis; thence South 3 degrees 10 minutes 45 seconds West 702.85 feet along the west line of Davis to a point being the southwest corner of Davis; thence North 77 degrees 30 minutes 29 seconds East 1,126.93 feet along the south line of Davis, Davis, Heidelberg and Huff to a point being the northwest corner of Neal; thence along the west line of Neal with the following locative calls: South 18 degrees 49 minutes 34 seconds West 728.73 feet; South 8 degrees 03 minutes 44 seconds East 30.83 feet; South 29 degrees 16 minutes 32 seconds West 91.20 feet; South 43 degrees 14 minutes 29 seconds West 95.88 feet; South 17 degrees 06 minutes 56 seconds West 91.63 feet; South 49 degrees 38 minutes 13 seconds West 56.68 feet to a point being the southwest corner of Neal and in the north line of Powell; thence North 85 degrees 41 minutes 57 seconds West 779.66 feet along the north line of Powell and Stokely to a point being the northwest corner of Stokely; thence north 3 degrees 10 minutes 46 seconds East 1,391.14 feet along the east line of Mabon and Shaw to the point of beginning, containing 19.51 aces.
Being the property conveyed to Antonio Snipes by deed of Kenneth Smith and Dana Carter recorded in Deed Book 268, page 39, Registerís Office, Haywood County, Tennessee.
Also conveyed is a 2005 Cavalier mobile home SN CV05AL0457049A/B, 160×32 feet, HUD Label Numbers NTA1349921 & NTA 1349922 which is permanently affixed to the real estate, See Affidavit of Affixation recorded in Record Book 61, page 243, Registerís Office of Haywood County, Tennessee.
Tract 2: Situated, lying and being in the 6th Civil District of Haywood County, Tennessee, and being more particularly described as follows to-wit:
Lot 1:
BEGINNING at a point being in the south margin of Coburn Road and at the northeast corner of a tract in the name of Charles Lee et ux (Deed Book 217, page 147 Registerís Office, Haywood County, Tennessee); runs thence East with the south margin of said road approximately 290 feet to the northeast corner of this now described tract and being the northwest corner of Heidelberg (Deed Book 212, page 715); runs thence with the West line of Heidelberg south approximately 670 feet to a point being the southeast corner of this now described tract and being the north line of Whitelaw; runs thence West with the North line of Whitelaw approximately 260 feet to a point being the southwest corner of this now described tract and the revised southeast corner of Charles Lee (see Deed Book 217, page 147 and Quitclaim Deed in Deed Book 237, page 552); runs thence North with the east line of Lee approximately 650 feet to the point of beginning and containing approximately 5 acres.

BEGINNING at an iron pin on the south margin of Coburn Road (30 feet at right angles from centerline) at the northeast corner of James Shaw ad recorded in Deed Book 138, page 465 in the Registerís Office of Haywood County Tennessee; thence with the south margin of Coburn Road, North 83 degrees 57 minutes East a distance of 339.33 feet to a point; thence South 0 degrees 17 minutes 37 seconds West a distance of 687.39 feet to a point in the centerline of a ditch; thence with said ditch North 74 degrees 41 minutes West a distance of 83.20 feet to a point; thence North 89 degrees 52 minutes West a distance of 135.97 feet to a point; thence North 52 degrees 25 minutes 13 seconds West a distance of 171.77 feet to an iron pin on the east line of Elsie Mabon; thence with Mabonís east line and the east line of Shaw North 2 degrees 00 minutes 41 seconds East a distance of 524.89 feet to the point of beginning. The above description being the western strip of land that was conveyed in error to Charles Lee, Deed Book 217, page 147, Registerís Office, Haywood County Courthouse, Brownsville, Tennessee. Prior to the execution of a quitclaim deed, recorded in Deed Book 237, page 552, Registerís Office, Haywood County, Tennessee, this strip of land encroached onto Clay Whitelawís 50-foot wide access strip.

The above description being part of the Charles Lee tract recorded in Book 217, page 147, Registerís Office, Haywood County Courthouse, Brownville, Tennessee. Prior to the execution of a quitclaim deed, recorded in Deed Book 237, page 552, Registerís Office, Haywood County, Tennessee, the above described tract encroached across the original southern line of Brooksí 60 acre tract onto Whitelawís tract.
Being the same lots or parcels of land conveyed to Antonio L. Snipes by deed dated February 8, 2011, and recorded in Record Book 85, page 266, Registerís Office, Haywood County, Tennessee.

BEGINNING at an iron pin found TN R.L.S. #508 in the south right of way of Coburn Road (30 feet from center line), which point is the northeast corner of Charles Heidelberg as recorded in Deed Book 212, page 715, Registerís Office of Haywood County, Tennessee, and the northwest corner of the herein described tract; thence from the point of beginning and with the south right of way of Coburn Road, North 74 degrees 03 minutes 23 seconds East 382.98 feet to a metal fence post found at the northwest corner of Ivy Delk as recorded in Reference Book 13, page 147, Registerís Office of Haywood County, Tennessee; thence with the west line of Delk South 18 degrees 50 minutes 00 seconds west 784.16 feet to a wood post found at the northeast corner of Antonio Snipes as recorded in Deed Book 268, page 39, Registerís Office of Haywood County, Tennessee; thence with the north line of Snipes South 77 degrees 30 minutes 55 seconds West 240.85 feet to a º inch rebar found at the southeast corner of Charles Heidelberg; thence with the east line of Charles Heidelberg North 9 degrees 52 minutes 59 seconds East 699.42 feet to the point of beginning, containing 4.62 acres. BEGINNING at a tpost found in the south margin of Coburn Road (ROW 60 feet) said tpost being the northeast corner of Antonio Snipes as described in Record Book 92, page 33; runs thence with said margin, north 73 degrees 57 minutes 44 seconds east 312.02 feet to a point in a ditch, in line with the easternmost culvert, said point being in the west line of Lejerwin Young and Tokesha Young as described in Record Book 34, page 433; runs thence with said ditch, south 28 degrees 11 minutes 24 seconds west 364.89 feet to a point; runs thence south 24 degrees 10 minutes 21 seconds west 514.19 feet to a point, said point being the southwest corner of said Young; runs thence leaving said ditch and with the north line of Amanda Glidewell as described in Deed Book 248, Page 454, south 77 degrees 30 minutes 55 seconds west, passing an iron post found at 40.00 feet, and continuing on for 174.22 feet to a double iron post found, said iron post being the southeast corner of aforementioned Snipes; runs thence with the east line of said Snipes, north 18 degrees 50 minutes 00 seconds east 784.16 feet to the point of beginning containing within these calls 153839.07 square feet or 3.53 acres of land as surveyed on August 10, 2011 by Evans & Associates Land Surveying, 320 South Washington, Brownsville, Tennessee.
