NOTICE OF SALE OF REAL ESTATE
WHEREAS BY Deed of Trust dated July 31, 2002, and recorded on July 31, 2002, appearing of record in Trust Deed Book 245, page 182, Registerís Office, Haywood County, Tennessee, whereby Alma Springfield conveyed to Thomas R. Chapman, Trustee, certain real estate therein described to secure the payment of a certain indebtedness therein set forth to Insouth Bank; and
WHEREAS, said Promissory Note and Deed of Trust were assigned to Habitat for Humanity of Haywood County, Inc., as reflected in Record Book 100, pages 587-588, of said Registerís Office; and
WHEREAS, an appointment of successor trust appointing Larry S. Banks of Banks Law Firm, P.A., as Successor Trustee as recorded in Record Book 157, page 249, Registerís Office, Haywood County, Tennessee; and
WHEREAS, default has been made in the payment of the indebtedness secured by the Deed of Trust and Habitat of Humanity of Haywood County, Inc., as the lawful holder of the note evidencing the indebtedness has declared the entire balance due and payable.
NOW, THEREFORE, notice is hereby given that on Thursday, January 11, 2018 at 10:00 a.m., at the front door of the Court House in Brownsville, Tennessee, I will sell to the last, highest and best bidder for cash or for credit bid against the secured debt in bar of all equities of redemption, homestead, dower and all other rights and exemptions, including statutory right of redemption under T.C.A. 66-8-101, all of which were expressly waived in the deed of trust, the following real estate lying and being in the Seventh Civil District and City of Brownsville, Haywood County, Tennessee, and more particularly described as follows:
BEING LOT NO. 17 for the Harris Estates Subdivision, as recorded in Plat Book 2, page 277, Slide 210, Registerís Office, Haywood County, Tennessee.
Being the same lot or parcel of land conveyed to Alma Springfield by deed of Habitat for Humanity of Haywood County, Inc. by deed recorded in Deed Book 252, Page 5, Registerís Office, Haywood County, Tennessee.
The street address of this property is 170 Channing Loop, Brownsville, Tennessee, 38012.
Said property will be sold by me as Successor Trustee only and subject to any unpaid taxes and assessments and all valid restrictions, covenants and easements, if any on record on said property, and subject to any and all other liens having priority over the Trust Deed. The Successor Trustee reserves the right to make oral announcements at the time of public sale which shall apply to the terms of sale. The Successor Trustee may postpone any sale hereunder to another time or place by so announcing to all present at the time and place of the sale scheduled herein, without the necessity of any further notice whatsoever.
