WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust dated March 24, 2006, executed by Frederick Carter, his heirs and assigns, to Carter, Stanfill & Kirk, PLLC, Trustee, for MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS NOMINEE FOR WILMINGTON FINANCE INC., its successors and assigns, and appearing of record on April 4, 2006, in the Registerís Office of Haywood County, Tennessee, at Instrument Number 5031.
WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to U.S. Bank National Association, the party entitled to enforce said security interest; and having appointed Clear Recon LLC, the undersigned, as Substitute Trustee by instrument filed or being filed for record in the Registerís Office of Haywood County, Tennessee, with all of the rights, powers, and privileges of the original Trustee named in said Deed of Trust.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust, and that the undersigned, Clear Recon LLC, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty, and authority vested and imposed upon said Substitute Trustee will, on January 11, 2018, at 11:00 AM, local time, at the Haywood County Courthouse, located in Brownsville, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Haywood County, to wit:
The land referred to herein below is situated in the County of Haywood, State of Tennessee, and is described as follows:
BEGINNING at a stake, the northwest corner of the original 10 acre tract which was conveyed to J.R. Powell by J. O. Bomer by deed recorded in Deed Book 73, Page 46, and it is also the northwest corner of the lot conveyed to David Earl Burfor, et ux by J. Roland Powell by deed of even date herewith; runs thence south with the original west line of said 10 acre tract 536.25 feet to a stake in the north margin of Cooper Avenue, said stake being the southwest corner of the original 10 acre tract; runs thence with the north margin of said Cooper Avenue 80 feet to a stake in the north margin of said Cooper Avenue; runs thence north to a stake a distance of approximately 535 feet, in the north boundary line of said original 10 acre tract, and which stake is approximately 80 feet from the beginning point or northwest corner of said original 10 acre tract; runs thence north 75 degrees west 80 feet to the beginning.
This being the same property conveyed to Frederick Carter by deed dated March 24, 2006 of record in Book 21, page 230 in the Registerís Office of Haywood County, Tennessee.

The transfer shall be AS IS, WHERE IS, AND WITH ALL FAULTS, and without warranties of any kind, express or implied, as to the condition of the Property and the improvements located thereon, including merchantability or fitness for particular purpose. Trustee shall make no covenant of seisin or warranty of title, express or implied, and will sell and convey the subject real property by Substitute Trusteeís Deed only.
The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. This sale may be rescinded by the Substitute Trustee at any time.
