NOTICE OF SUBSTITUTE TRUSTEEíS SALE OF REAL ESTATE
WHEREAS, on September 1, 2017, LUCINDA CHILCUTT AKA LUCINDA C. CHILCUTTT, et. ux., by Deed of Trust of record in Record Book 156, at Page 396, in the Registerís Office of Haywood County, Tennessee, conveyed the following described property in trust to secure the payment of a Promissory Note in the original principal amount of Eight Hundred Fifty One Thousand Thirty Six and 05/100 ($851,036.05) payable to Farm Credit Mid-America, PCA; and
WHEREAS, the undersigned was appointed Substitute Trustee by Farm Credit Mid-America, PCA, which appointment will be recorded in the Registerís Office of Haywood County, Tennessee prior to the deed evidencing this sale; and
WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and FARM CREDIT MID-AMERICA, PCA, the lawful owner and holder of the said indebtedness, has declared the entire amount due and payable as provided by the Deed of Trust in accordance with the terms thereof, and instructed the undersigned to foreclose; and
NOW, THEREFORE, the public is hereby notified that the undersigned Substitute Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand paid, at the east door of the Courthouse at Brownsville, Haywood County, Tennessee, on Wednesday, May 16, 2018, at 10:00 oíclock a.m., said property to be sold in bar of the equity of redemption and subject to the lien of all special assessments against it. If the highest bidder cannot pay the bid within twenty-four (24) hours of the sale, the next highest bidder will be deemed the successful bidder.
Lying, and being situate in the 6th Civil District, Haywood County, Tennessee, bounded and described as follows; to-wit:
BEGINNING at a stake in the east margin of a gravel road which leads from the Mercer to Brownsville blacktop road, to U.S. Hwy 70 and known as Cox Lane, said stake being in the northwest corner of a tract in the name of Boggs and in the east margin of said gravel road, runs thence east with Boggsí north line 35 rods to a stake, runs thence north and parallel with the east margin of said gravel road 23 rods to a stake, runs thence west and parallel with Boggsí north line 35 rods to a stake in the east margin of said gravel road, thence south with the east margin of said gravel road 23 rods to a stake, the point of beginning, and containing 5 acres, more or less.
It being the same property as that described in a Substitute Trusteeís Deed from C. V. Cochran, Jr., Substitute Trustee, to Terry L. Chilcutt and wife, Lucinda C. Chilcutt, dated April 7, 1983, and of record in Deed Book 156, page 479, in the Registerís Office of Haywood County, Tennessee. Terry L. Chilcutt died on November 1, 2017, and upon his death, Lucinda C. Chilcutt became the owner of said property as surviving tenant by the entirety.

The street address of the above described property is believed to be 1504 Cox Lane, Brownsville, TN 38012, but such address is not part of the legal description and in the event of any discrepancy, the legal description herein shall control.
SALE IS SUBJECT TO TENANT(S) RIGHTS IN POSSESSION, IF ANY.
Title to said property is believed to be good, but the undersigned will sell as Substitute Trustee only and will assign to the purchaser all covenants of warranty contained in said Deed of Trust. Other interested parties: None.
Said sale may be adjourned to another time or may be postponed to another date by public announcement at the appointed time of sale without readvertisement.
