SUBSTITUTE TRUSTEEíS NOTICE OF SALE
Sale at public auction will be on March 26, 2020, at or about 1:00 PM, local time, at the east door of the Haywood County Courthouse, 1 North Washington Brownsville, TN 38012, pursuant to the Deed of Trust executed by Odis Elrod and wife, Bonnie Elrod, to John Bruno, as Trustee for Community Choice Financial Services, Inc. dated March 25, 2005, and recorded in Record Book 4, Page 721, in the Registerís Office for Haywood County, Tennessee (ìDeed of Trustî), conducted by Padgett Law Group, having been appointed Substitute Trustee, all of record in the Haywood County Registerís Office. Default in the performance of the covenants, terms, and conditions of said Deed of Trust has been made; and the entire indebtedness has been declared due and payable.

The hereinafter described real property located in Haywood County will be sold to the highest call bidder subject to all unpaid taxes, prior liens and encumbrances of record:
Legal Description: The following described lot or parcel of land, situate, lying and being in the 1st Civil District of Haywood County, Tennessee, and more particularly described as follows:
BEGINNING at a stake in the center of the Hillville to Hatchie Wildlife Road, the northeast corner of a lot in the name of Herbert Hayes see Deed Book 102, Page 53, in the Register`s Office of Haywood County, Tennessee; runs thence West with the north boundary line of the Herbert Hayes lot 4.71 chains to a stake, the northwest corner of the Hayes lot and in the eastern boundary line of a tract in the name of W. H. Bruce; runs thence North with the east boundary line of the Bruce tract 6.15 chains to a stake; runs thence East with the south boundary line of a lot in the name of Jordan Bruce 6.95 chains to a stake in the center of the above mentioned road; runs thence in a southerly direction following the center line of said road 8.00 chains to the Point of beginning, and containing 3.70 acres, more or less.
THERE IS INCLUDED IN THE ABOVE DESCRIBED TRACT, BUT EXPRESSLY EXCLUDED from the above-described property is the following described one (1) acre parcel of land, which is more particularly described as follows:
BEGINNING on a point in the centerline of Hillville Loop Road, which point is the southeast corner of Jordan Bruce (Deed Book 96, Page 293) and the original northeast corner of Elrod; thence from the point of beginning, and with the centerline of said road, South 10 degrees 01 minute 10 seconds West 282.28 feet to the southeast corner of the herein described tract; thence on new lines through Elrod the following calls: North 76 degrees 48 minutes 46 seconds West 294.44 feet; North 00 degree 00 minute 00 second West 109.91 feet to an iron pin set in the south line of Bruce; thence with the south line of Bruce and generally with a fence, East 317.96 feet to the point of beginning, containing 1.00 acre.
Street Address: The street address of the property is believed to be 2936 Hillville Loop, Whiteville, TN 38075, but such address is not part of the legal description of the property. In the event of any discrepancy, the legal description herein shall control.

This sale is subject to all matters shown on any applicable recorded Plat or Plan; any unpaid taxes and assessments; any restrictive covenants, easements or setback lines that may be applicable; rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of Trust, including rights of redemption of any government agency, state or federal; and any and all prior deeds of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters that may take priority over the Deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this Foreclosure Sale.
THE PROPERTY IS SOLD WITHOUT ANY REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, RELATING TO TITLE, MARKETABILITY OF TITLE, POSSESSION, QUIET ENJOYMENT OR THE LIKE AND FITNESS FOR A GENERAL OR PARTICULAR USE OR PURPOSE. The title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
The right is reserved to adjourn the sale to another time certain or to another day, time, and place certain, without further publication upon announcement on the day, time, and place of sale set forth above or any subsequent adjourned day, time, and place of sale.
If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified check made payable to or endorsed to Padgett Law Group. No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered.
This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. This sale may be rescinded by the Substitute Trustee at any time.
