SUBSTITUTE TRUSTEEíS SALE
Sale at public auction will be on March 22, 2018 at 10:00 a.m., local time, at the east door of the Haywood County Courthouse, 1 North Washington Brownsville, TN 38012, pursuant to Deed of Trust executed by Larry Jackson, a single man, to Banks Law Firm, P.A., as Trustee for Mortgage Electronic Registration Systems, Inc. (ìMERSî) as nominee for LOANDEPOT.COM, LLC dba iMortgage, dated March 29, 2016, of record in Record Book 140, Page 3, in the Registerís Office for Haywood County, Tennessee (ìDeed of Trustî), conducted by Padgett Law Group, having been appointed Substitute Trustee, all of record in the Haywood County Registerís Office. Default in the performance of the covenants, terms, and conditions of said Deed of Trust has been made; and the entire indebtedness has been declared due and payable.

The hereinafter described real property located in Haywood County will be sold to the highest call bidder subject to all unpaid taxes, prior liens and encumbrances of record:.
Legal Description: LYING and being situate in the 7th Civil District of Haywood County, Tennessee and being more particularly described as follows, to-wit: COMMENCING at a point being the intersection of the south margin of West College Street, back of curb, and the west margin of Russell Street, back of curb; thence West 95.00 feet along the south margin of West College Street to a point, said point being the northeast corner and the point of beginning of the following described lot; thence South 0 degree 31minutes 10 seconds West 150.89 feet along the west line of Thornton to a point in the south edge of a concrete block wall; thence North 89 degrees 35 minutes 48 seconds West 77.15 feet along the south edge of said concrete block wall to the most southerly corner of the concrete block wall; thence South 1 degree 01 minute 55 seconds East 10.85 feet along a chain link fence to an iron pin set; thence South 89 degrees 55 minutes 50 seconds West 77.90 feet with a new line to a point in the concrete block wall on the east side of Farrar Place; thence North 0 degree 39 minutes 38 seconds East 161.29 feet along the east line of Farrar Place to a point in the south margin of West College Street, thence East 154.37 feet along the south margin of College Street, back of curb, to the point of beginning containing 0.55 acre as surveyed by Walter R. Powell, RLS 832, on August 18, 1999.
Street Address: The street address of the property is believed to be 318 West College Street, Brownsville, TN 38012, but such address is not part of the legal description of the property. In the event of any discrepancy, the legal description herein shall control.

This sale is subject to all matters shown on any applicable recorded Plat or Plan; any unpaid taxes and assessments; any restrictive covenants, easements or setback lines that may be applicable; rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of Trust, including rights of redemption of any governmental agency, state or federal; and any and all prior deeds of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters that may take priority over the Deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this Foreclosure Sale.
THE PROPERTY IS SOLD WITHOUT ANY REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, RELATING TO TITLE, MARKETABILITY OF TITLE, POSSESSION, QUIET ENJOYMENT OR THE LIKE AND FITNESS FOR A GENERAL OR PARTICULAR USE OR PURPOSE. The title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
The right is reserved to adjourn the sale to another time certain or to another day, time, and place certain, without further publication upon announcement on the day, time, and place of sale set forth above or any subsequent adjourned day, time, and place of sale.
If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified check made payable to or endorsed to Padgett Law Group. No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received, in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered.
