COUNTY OF HAYWOOD
WHEREAS, by Deed of Trust dated May 1, 2019 and recorded on May 7, 2019, THOMAS SMITH and wife, VIRGINIA SMITH conveyed to Carter, Stanfill & Kirk, Trustee, certain real property located in Haywood County, Tennessee, which deed of trust is of record in Record Book 174, Page 543, Registerís Office, Haywood County, Tennessee, for the purpose of securing the payment of the indebtedness therein set out and described, to which deed of trust reference is heremade for the particulars thereof; and
WHEREAS, default having been made in the payment of the debt(s) and/or obligation(s) thereby secured by said Deed of Trust and the current holder of said Deed of Trust, THOMAS C. HAMES and NICOLE M. HAMES, appointed the undersigned, Joshua B. Shearon, as Successor Trustee, by an instrument duly recorded in the Registerís Office of Haywood County, Tennessee in Record Book 180, Page 61, with all rights, powers and privileges of the original Trustee named in the said Deed of Trust; and
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by Holder, and that by virtue of the authority vested in me by the said Deed of Trust as Trustee, notice is hereby given that on Tuesday, December 17, 2019 at 10:00 a.m. at the East door of the Courthouse for Haywood County, Tennessee located in Brownsville, Tennessee, or as may be continued from time to time, I will sell to the highest and best bidder for cash, the following described real estate and improvements located thereon, lying and being in the 9th Civil District of Haywood County, Tennessee, and more particularly described as follows, to-wit:
BEGINNING at a point which is 105 feet from the west boundary of R.V. Cannon and in the south margin of a proposed road conveyed this date to Haywood County, Tennessee, to be known as River Side Drive, and in the northeast corner of Lot 52, R.V.Cannon Hatchie River Subdivision and the northwest corner of this now described lot; thence along the south margin of the said River Side Drive in an northeasterly direction 95 feet to a stake in Lot No. 50, R.V. Cannon Hatchie River Subdivision; thence south along the east boundary line of this now described lot and the west boundary line of Lot No. 50 of said subdivision 295 feet to a stake; thence west 85 feet to a stake in the southeast corner of Lot No. 52 of said subdivision; thence north 273 feet to the margin of said River Side Drive and the point of beginning and containing Ω acre, more or less. Being Lot No. 51, R.V. Cannon Hatchie River Subdivision see Plat Book 2, Page 183, Registerís Office, Haywood County, Tennessee.
Per TCA ß66-25-121, the foregoing legal description is the same as contained in a previous deed of record.
There is further conveyed a 1974 Chal Mobile Home, Vehicle Identification Number 7412372156 which has been permanently affixed to the above described real estate and incorporated therein so as to become a part of the real property and shall pass hereafter as a permanent fixture and appurtenance to the same.
BEING the same real property conveyed unto Thomas Smith and wife, Virginia Smith by deed as recorded in Record Book 174, Page 541 in the Registerís Office of Haywood County, Tennessee.

This property is commonly known as 140 Riverside Drive, Brownsville, TN 38012.
SAID SALE will be to the highest and best bidder for cash and free from the equity of redemption, dower, homestead, and such other exemptions which are specifically waived in said deed of trust; and the title to said property is believed to be good, but I will sell and convey as trustee only under the terms and authority of the Deed of Trust hereby foreclosed.
SAID SALE may be adjourned to another time or may be postponed to another date by public announcement at the appointed time of sale without readvertisement.
SAID SALE shall be subject to unpaid property taxes, assessments, subdivision restrictions, building lines, easements and all prior liens and encumbrances of record superior in right to the Deed of Trust; and any matter that an accurate survey of the premises might disclose.
THERE WERE no recorded liens against Thomas Smith or Virginia Smith by the United States of America with respect to which provisions of 26 U.S.C. ß7425(b) require notice to be sent to the United States of America.
THERE WERE no recorded liens against Thomas Smith or Virginia Smith by the State of Tennessee with respect to which provisions of Tennessee Code Annotated ß67-1-1433(b)(1) require notice to be sent to the State of Tennessee.
There are no LIEN HOLDERS of record for which notice has to be given.
